Terms & Conditions

Welcome to Ride Away Rentals LLC (“we,” “our,” or “us”). By renting a vehicle, accessing our services, or using our website, you (“Renter,” “you,” or “your”) agree to be legally bound by the following Terms and Conditions. Please read these terms carefully. If you do not agree, you must not use our services.

 

1. Eligibility & Verification

To rent a vehicle from Ride Away Rentals, you must:

  • Be at least 21 years old

  • Provide a valid driver’s license (out-of-state licenses accepted)

  • Provide valid contact information and payment method

  • Agree to all terms and sign the rental agreement prior to taking possession of the vehicle

We reserve the right to verify your identity, driving history, criminal record, and eligibility prior to approving any rental.

 

2. Vehicle Use

  • Vehicles must be operated only by the renter or approved additional drivers listed in the rental agreement.

  • Vehicles may not be used for illegal activity, racing, towing, off-roading, or in any manner prohibited by law.

  • Renters must comply with all traffic laws and are responsible for all tickets, tolls, and violations incurred during the rental period.

  • Unauthorized drivers or misuse may result in immediate termination of the rental and forfeiture of deposits.

 

3. Keyless Entry & Technology

  • Many of our vehicles use keyless entry via a secure mobile app. Renters must maintain the confidentiality of their app credentials and must not share access with unauthorized persons.

  • Vehicles may be equipped with GPS tracking and dash cameras for security, theft prevention, insurance, and policy enforcement.

  • Tampering with, disabling, or obstructing GPS or dash cameras is strictly prohibited and may result in additional fees, legal action, or criminal charges.

 

4. Payment & Deposits

  • Rental fees, deposits, and applicable taxes must be paid in full prior to vehicle release.

  • Deposits are typically $200–$500 depending on the vehicle and are refundable within 2–10 business days after return, provided there are no outstanding tolls, violations, damages, or cleaning fees.

  • If tolls or violations occur, these may be deducted from your deposit or charged to your payment method on file.

  • All payments must be made using accepted methods (credit/debit cards, Zelle, Cash App, or approved cash deposit).

 

5. Cancellations & Extensions

  • Reservations may be canceled prior to the scheduled start time; cancellation fees may apply.

  • If you need to extend your rental, you must contact us in advance for approval.

  • Failure to return a vehicle on time without prior approval may result in late fees, additional daily charges, and possible reporting as unauthorized use or theft.

 

6. Return Policy

  • Vehicles must be returned on or before the scheduled return date and time.

  • Vehicles are subject to interior and exterior inspection at drop-off.

  • Mechanical inspections and toll reconciliations are completed after return.

  • Smoking / Ashes in the vehicle is strictly prohibited. A $250 smoking fee will be charged if evidence of smoking is found.

  • Additional cleaning fees may apply if the vehicle is returned excessively dirty or with food debris.

  • Failure to return the vehicle at the agreed time may result in repossession and additional charges.

7. Tolls, Tickets & Violations

You are fully responsible for:

  • Tolls incurred during your rental period

  • Traffic tickets, parking violations, and fines

  • Any administrative or processing fees associated with tolls and violations

These may be deducted from your deposit or charged to your payment method after your rental period.

 

8. Accidents, Theft & Damage

  • In the event of an accident, theft, or damage, you must notify us immediately.

  • Insurance claims may be filed, and you may be responsible for deductibles, uncovered damages, or costs due to negligence.

  • Failure to report incidents promptly may result in denial of coverage and full financial responsibility.

 

9. Prohibited Conduct

You may not:

  • Smoke or vape inside any vehicle

  • Use the vehicle for illegal activities

  • Sub-rent or lend the vehicle to others

  • Tamper with vehicle technology or safety equipment

  • Operate the vehicle while impaired by drugs or alcohol

Violation of these rules may result in immediate termination, additional fees, and legal action.

 

10. Limitation of Liability

To the fullest extent permitted by law, Ride Away Rentals LLC shall not be liable for:

  • Indirect, incidental, or consequential damages arising out of vehicle use

  • Loss of personal property left in the vehicle

  • Delays, interruptions, or unavailability due to maintenance, breakdowns, or unforeseen events

 

11. Indemnification

You agree to indemnify, defend, and hold harmless Ride Away Rentals LLC, its owners, employees, and affiliates from any claims, damages, losses, or expenses (including attorney’s fees) arising out of:

  • Your use or misuse of the vehicle

  • Your breach of these Terms & Conditions

  • Any accidents, violations, or unlawful activity during your rental

 

12. Termination

We reserve the right to deny, suspend, or terminate rentals at our sole discretion for policy violations, suspected fraud, or safety concerns, without prior notice.

 

13. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any disputes shall be resolved in a court of competent jurisdiction located in Harris County, Texas.

 

14. Modifications

We may update or modify these Terms & Conditions at any time. Updates will be posted on our website with the revised “Effective Date.” Continued use of our services constitutes acceptance of the revised terms.
